HIPAA Notice of Privacy Practices

This Notice describes how health information about you may be used and disclosed, how you can access this information, and the rights you have regarding your protected health information.

Our Commitment to Your Privacy
All Birth Care is committed to protecting the privacy and confidentiality of your health information.
When applicable, we maintain and use protected health information in accordance with the Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA, and other applicable federal and state privacy laws.
Protected Health Information, or PHI, generally includes information that identifies you and relates to your health, healthcare services, or payment for healthcare.
HIPAA-covered healthcare providers are required to provide individuals with notice of their privacy practices and privacy rights.
How We May Use and Disclose Your Health Information
We may use or disclose your health information as permitted or required by law. Common examples include:
Treatment and Care Coordination
We may use or share your information to help coordinate services, communicate with healthcare providers involved in your care, arrange referrals, or support the services you receive through All Birth Care.
Payment
We may use or disclose information when necessary to obtain payment for services, verify insurance eligibility or benefits, process claims, or communicate with your health plan regarding coverage.
Healthcare Operations
We may use your information for activities necessary to operate and improve our services, including:
- Quality improvement
- Staff training
- Administrative activities
- Compliance and auditing
- Business planning
- Customer service
- Care coordination activities
Business Associates
We may work with outside companies or service providers that perform services on our behalf and may need access to PHI.
When HIPAA requires it, these organizations must enter into written agreements requiring them to appropriately safeguard protected health information.

Public Health and Safety
Where permitted by law, we may disclose health information for certain public health activities, such as reporting information to authorized public health authorities or helping prevent a serious threat to health or safety.

We may disclose health information in response to certain court orders, subpoenas, administrative proceedings, or other lawful processes, subject to applicable legal requirements.

HIPAA permits certain disclosures to law enforcement under specifically defined circumstances.
Other Uses and Disclosures
Uses or disclosures of your health information that are not otherwise permitted by law generally require your written authorization.
If you provide written authorization, you may revoke that authorization at any time in writing, except to the extent that action has already been taken based on your authorization.
Your Rights Regarding Your Health Information
Depending on applicable law and the information maintained by All Birth Care, you may have the following rights.
Right to Access Your Information
You may request to inspect or receive a copy of certain health information maintained about you.
Right to Request a Correction
If you believe information in your record is incorrect or incomplete, you may request that it be amended.
We may deny certain requests when permitted by law, but we will explain the reason when required.
Right to Request Restrictions
You may ask us to limit certain uses or disclosures of your health information.
We are not required to agree to every requested restriction unless otherwise required by law.
Right to Request Confidential Communications
You may ask us to contact you in a particular way or at a particular location.
For example, you may request that we contact you only through a specific phone number or email address.
Right to an Accounting of Disclosures
In certain circumstances, you may request a list of certain disclosures of your protected health information made during a specified period.
Right to a Copy of This Notice
You may request a paper or electronic copy of this Notice at any time, even if you previously agreed to receive it electronically.
Our Responsibilities
When applicable under HIPAA, All Birth Care is required to:
- Maintain the privacy of protected health information
- Follow applicable privacy and security requirements
- Provide you with this Notice describing our legal duties and privacy practices
- Follow the terms of the Notice currently in effect
- Notify affected individuals following certain breaches of unsecured protected health information, when required by law
HHS states that covered entities must maintain the privacy of PHI and explain their legal duties and privacy practices to individuals.
Minimum Necessary Information
When applicable, we make reasonable efforts to limit the use, disclosure, or request of protected health information to the minimum amount reasonably necessary to accomplish the intended purpose, except where an exception applies.
Electronic Communications
Email, text messaging, web forms, client portals, and other electronic communications may be used to communicate with you when appropriate.
Although we take reasonable measures to protect information, no method of electronic communication can be guaranteed to be completely secure.
Please avoid sending highly sensitive health information through ordinary email or other unsecured communication methods unless specifically instructed to do so through an approved secure system.
Website and Online Forms
Information submitted through eligibility forms, intake forms, client portals, scheduling tools, or other website features may be collected and used to:
- Respond to your request
- Verify eligibility or coverage
- Coordinate services
- Schedule appointments
- Connect you with available care or support resources
- Perform administrative activities related to your request
Where information constitutes protected health information, it will be handled in accordance with applicable privacy requirements.
Complaints
If you believe your privacy rights have been violated, you may submit a complaint directly to All Birth Care.
You will not be retaliated against for filing a privacy complaint.
You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights (OCR). HHS confirms that individuals may submit complaints to OCR when they believe their HIPAA privacy rights have been violated.
Changes to This Notice
We may revise this Notice when our privacy practices, services, or applicable legal requirements change.
Any revised Notice will include a new effective date and may be posted on our website or otherwise made available as required by law.
HIPAA requires covered entities to revise their notice when material changes are made to their privacy practices.

One important compliance note: HHS updated its model HIPAA notices in 2026, including requirements related to certain 42 CFR Part 2 substance use disorder records. If All Birth Care creates or maintains Part 2 records, this notice needs additional language specific to those records.
